General Terms and Conditions of Purchase at "Mineral y Fosil"

1. What is this document?

This text constitutes the CONTRACT that will govern the relationship between "Mineral y Fosil" ADOLFO BEATO BANDERAS, with NIF 70040780-F and domicile at PS SAGASTA 17 3º B - 50008 - ZARAGOZA and You (the USER), upon acquiring products through our online store "Mineral y Fosil". This text describes the conditions that regulate the contracting of products through our online store, the rights and obligations of the parties, and information on how to buy, all in compliance with Law 34/2002, of July 11, on Services of the Information Society and Electronic Commerce (LSSI).

2. Acceptance and duration of the general terms.

These General Terms and Conditions are mandatory for both parties. The CLIENT will be bound by each and every one of these General Terms and Conditions without reservation when purchasing our products on the "Mineral y Fosil" website, being their obligation and responsibility to read them beforehand.

During the course of your order, prior to authorizing payment, the CLIENT must accept the General Terms and Conditions. If you do not agree with them, do not continue with the purchase process, as these conditions will apply to you in any case.

3. Products.

"Mineral y Fosil" is a company dedicated to the sale of minerals, fossils, gems, and related items.

4. Prices.

All prices that appear on "Mineral y Fosil" include VAT, and their price will be that specified on the website at all times.

"Mineral y Fosil" reserves the right to modify the prices and conditions of sale of the products. However, the price and conditions that were established at the moment the CLIENT placed the order will always be respected and applied.

5. Shipping Costs.

"Mineral y Fosil" carries out shipments through the transport companies Correos, Correos express, CTT, DHL, Ontime, FedEx, GLS, and Inpost through the Genei system, an online shipping platform that selects the best available company for you.

Shipping costs depend on the weight of the product and the destination country. When placing your order, shipping costs will be calculated automatically once your Identification Details are filled in, but these will not be registered until you complete the purchase.

You can also consult them in the Shipping Costs section of our website, located in a visible part and published at all times.

They will be free for purchases over 50 euros in Spain and 100 euros in Europe.

6. Purchase Process.

The CLIENT must be at least 18 years of age. The steps are as follows:

1. Once the desired product or products have been selected, you will access the "Shopping Cart" where all the products will be displayed in a list, showing the product name, the final price including taxes, and any applicable discounts.
2. In both cases, you will be required to fill out a form with your personal data, which will allow you to acquire the product and make the purchase. When filling in the identification data, specifically the Postal Code in the case of Spain or the Country in the rest, shipping costs will automatically appear, except in cases where they are free, which will also be shown in a message. You can choose the payment method and a different shipping address from the billing address, if desired.
3. In both cases, by selecting the "Confirm Purchase" button, the contracting process is formalized, but not before checking the box to Accept the terms of contract and privacy policy. Once the order is placed, it will be subject to our acceptance. Within the following 48 hours, we will send a confirming email. "Mineral y Fosil" is not responsible for errors or failures of the email address provided by the CLIENT.

7. Payment Methods.

"Mineral y Fosil" offers you ONE PAYMENT OPTION, guaranteeing its security and confidentiality:

• Payment via bank transfer.

The moment we receive the amount of the transaction, we will proceed with the shipment of the purchased items.

8. Product Delivery.

Depending on the payment method, the waiting time for the purchased product may range between 2 and 10 days, although in any case, delivery will be made within a maximum period of 30 days from the date of the contract.

9. Product Availability.

All our products are unique pieces. If they are not in stock, you will be informed as soon as possible and offered an alternative or the order will be cancelled, at the client's choice. The amount will be reimbursed within a maximum period of 14 days. The refund of these amounts will be the limit of our liability towards the client if it is impossible for us to provide the requested product.

10. Product Warranty.

A two-year warranty will apply to products that present some type of defect or flaw. Those non-conformities of the product that result from misuse of the product or ordinary wear and tear produced by its use will not be considered.

If a product is defective, "Mineral y Fosil" will proceed to repair, replace, reduce the purchase price, or terminate the contract. All these measures will be at the buyer's choice and free of charge for them, with the shipping costs of the product being borne by "Mineral y Fosil".

The claim must be submitted within two months from the moment the lack of conformity of the product is detected, describing the problem in an email to info@mineralyfosil.com, and we will contact you to resolve your claim.

11. Customer Service.

12. Responsibilities.

"Mineral y Fosil" is not responsible, in any case, for damages of any nature that may be caused, such as but not limited to, the following actions: possible failures of the Internet server that prevent access to one or more pages of the Portal, errors or omissions in the Contents or the transmission of viruses or malicious or harmful codes in the Contents, despite having adopted all technical measures to avoid it.

14. Intellectual and Industrial Property.

"Mineral y Fosil", by itself or as an assignee, is the owner of all intellectual and industrial property rights of the Portal, as well as the elements contained therein (by way of example, images, sound, audio, video, software or texts; brands or logos, color combinations, structure and design, selection of materials used, computer programs necessary for its operation, access and use, etc.), owned by "Mineral y Fosil" or its licensors. All rights reserved. By virtue of the provisions of articles 8 and 32.1, second paragraph, of the Intellectual Property Law, the reproduction, distribution and public communication, including the method of making them available, of all or part of the Contents of this web page, for commercial purposes, in any medium and by any technical means, without the authorization of "Mineral y Fosil", are expressly prohibited. The User agrees to respect the Intellectual and Industrial Property rights owned by "Mineral y Fosil". The User must refrain from deleting, altering, evading or manipulating any protection device or security system that was installed on the pages of "Mineral y Fosil".

15. Integrity of the Contract.

If any of the clauses of this contract were voidable or null and void by full right, it will be considered as not included, maintaining the rest of the contract all its binding force between the parties.

16. Applicable Law and Competent Jurisdiction.

In the event of any conflict, controversy, or legal dispute that may arise, "Mineral y Fosil" and the User will be governed, as well as these Terms and Conditions, by the current Spanish regulations and will submit, if applicable, to the Courts and Tribunals of the city of Madrid, Spain.
